Less paperwork for Puerto Rico property owners

Effective upon approval, this Puerto Rico law simplifies forms for deeds that split, combine, or transfer real estate. Notaries report the transaction’s price or value instead of an appraised price. The form no longer requires a professional appraisal, survey plan, or title study. It still requires the deed number, date, and transaction type; parties’ full names, roles, and Social Security numbers; property registry details; and property type, location, and address. The deed type must also be listed when applicable. The property’s tax identification number must come from the latest municipal tax notice or receipt issued by CRIM, the municipal tax collection agency. CRIM must provide the number within seven days of a request or issue a certificate explaining why it cannot. That certificate must accompany the form sent to Treasury and CRIM. For residential transfers, notaries must tell buyers planning to use the home as their main residence to apply for the property tax exemption under Law 107-2020. This warning must appear in the deed. For transactions involving stamp and related fee exemptions under Laws 132-2010, 216-2011, or 226-2011, notaries must certify their applicability at the deed’s end, based on the parties’ statements. Notaries must attach the seller’s new-construction certificate issued under those laws to the form. They must send the previous month’s forms to Treasury by the 10th, using Treasury’s required filing method, which may include electronic filing. Treasury must share electronically filed forms with CRIM. Treasury must report Legal Aid Society revenue lost through Law 216-2011 incentives to the budget office, which must allocate replacement funding. Conflicting laws and administrative rules are repealed or amended to match this law.
