Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Eight-year sentences for protective order violations

In Puerto Rico, knowingly breaking a domestic violence protective order is a felony with a fixed eight-year prison sentence. Courts must require electronic monitoring whenever they grant any type of suspended sentence. Police must arrest when presented with an order under this law or a similar law and grounds to believe it was violated. This duty also applies when police have sound reasons to believe an order exists based on communications with authorities, the protected person's employer, or residential access security. These rules took effect immediately upon approval.

Child abuse aggravates domestic violence charges

In Puerto Rico, domestic abuse committed at the same time as child abuse counts as aggravated domestic abuse. Child abuse follows the definition in Law 57 of May 11, 2023, as amended. Courts may order restitution for aggravated domestic abuse in addition to prison. This repayment is not guaranteed, and the law sets no amount. These changes took effect immediately upon approval.

Prison and repayment for restricting partners' freedom

In Puerto Rico, restricting a covered person's freedom through violence or intimidation is a felony carrying a fixed eight-year prison sentence. The rule also covers using a claimed mental illness or defect as a pretext, with the victim's knowledge. Covered people include spouses, former spouses, current or former live-in or consensual partners, and people who share a child. Protection applies regardless of sex, marital status, sexual orientation, gender identity, or immigration status. Courts may also order repayment to victims, called restitution, in addition to prison. These rules took effect immediately upon approval.
