Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Judges must write reasons for orders

In every protection‑order hearing, the magistrate must write brief facts and legal reasons. This applies whether the court grants the order or finds no cause. The written record shows how the decision was made.

Protective orders require giving up guns

When a court issues a protective or stalking order, the respondent must turn in all firearms to the Puerto Rico Police. The court suspends all gun licenses for at least as long as the order lasts. Breaking these rules can lead to permanent license loss and firearm confiscation.

Threats to pets are domestic abuse crimes

The law now treats harming or threatening a pet as domestic violence. This applies when it is used to hurt or control the victim. Threats by text, voicemail, email, social media, or any digital tool are covered. Making these threats is a fourth‑degree felony in its upper range. Courts can order the offender to pay restitution.

Limited diversion program with strict conditions

After a guilty plea or judgment for a Law 54 offense, the court can pause the case and place the person on probation tied to a reeducation program. To qualify, the person must have no prior final conviction with imprisonment, no current diversion or suspended sentence for similar offenses, no violation of a protection order, and no conviction under Article 3.2A (including attempt). The prosecutor, the accused, and the program must sign a written agreement that includes the accused’s admission. The court hears the prosecutor and considers the victim’s view. Probation lasts 1 to 3 years. Finishing the program can lead to a one‑time dismissal, confidential/sealed records, and return of fingerprints and photos.
