Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Penalties and safe harbor for facilities

If a facility ignores the oral health rules, the Department of the Family can fine it up to $500 per violation. The Department can also suspend the facility’s license. A temporary exception applies if the facility logs at least three diligent attempts to get dental services. Each entry must list the provider’s name, phone number used, date, and time. When services are truly unavailable for reasons outside the facility’s control, lack of exams alone does not cause license loss.

Dental exams required for eldercare residents

Eldercare facilities must place a dentist-certified oral exam in each new resident’s file. The exam can count if done up to 60 days before entry. If health requires, it can be done within 60 days after admission without delaying care. The facility must record at least one dental check each year. Results go in the medical record, and exams need informed consent from the resident or legal representative.

Help paying and scheduling dental exams

If a resident is economically vulnerable, the Department of the Family pays all or part of the exam and report. The Department works with other agencies, health officials, and dental schools to schedule visits. Plans include free clinics and home visits for people with limited mobility. Dental students may do exams under a licensed dentist’s direct supervision. Health regulators and the Dental Board set the rules, and the Department of the Family issues regulations within 60 days of approval.
