Bill Overview

Analyzed Economic Effects

4 provisions identified: 3 benefits, 0 costs, 1 mixed.

Parental consent and safeguards for young teens

Puerto Rico sets new abortion rules for minors age 15 or younger who are not legally emancipated. Except under the law’s exceptions, a parent with parental authority or legal custodian must receive prior written notice and attend. That adult must sign written informed consent at the facility and show qualifying photo identification. A licensed social worker or professional counselor must first interview the minor alone to check for possible sexual assault. Providers must immediately refer the case to the Department of the Family, even when the adult consents. The file must include the referral number, date and time, plus copies of the required consent form and adult’s identification. Providers must keep required records for at least five years. The law takes effect upon approval and directs the Department of Health to issue or expand implementing rules.

Consent exception when teens accuse parents

For minors age 15 or younger, an exception applies when the minor says a parent or legal custodian caused the pregnancy. That adult’s presence and informed consent are not required before the abortion. The provider must take emergency custody under Article 9 of Law 57-2023. The provider must record the Department of the Family referral number, date and time. The provider must also notify Puerto Rico’s Department of Justice about the emergency-custody case.

Emergency abortion access for young teens

For covered minors, doctors can bypass prior notice and consent when an emergency puts the minor’s life at imminent risk. The doctor must certify in writing in the medical record that delay would endanger the minor’s life. The provider must try to contact a parent or legal custodian immediately. If contact fails, certified mail with return receipt must go to the known address within 24 hours. The notice must include the clinic’s details and the doctor’s license information. Those involved must keep evidence of notice or consent attempts in the minor’s record for at least five years.

Criminal penalties for forcing minors’ abortions

The law makes it a crime to force a pregnant minor to end a pregnancy. It covers force, coercion, threats and physical violence. The offense carries a fixed three-year prison term and a $25,000 fine.
