Gender-transition medical care banned under 21

Puerto Rico bans surgery and medicines that change sex biology for gender transition or gender dysphoria in people under 21. Covered care includes puberty blockers, sex hormones, and surgery that changes or removes sex organs. Exceptions allow guideline-based treatment for intersex variations or other physiological genetic or hormone disorders certified by a pediatric endocrinologist or pediatrician. Treatment for medical conditions outside the law’s definition of prohibited interventions is also exempt. Public resources cannot pay for, promote, assist, or endorse covered interventions.

Families get education about intervention risks

Puerto Rico’s education and health departments must create public education programs about risks of the covered gender-transition medical interventions. Programs target the community, parents, guardians, and health professionals. They must stress respect, dignity, and the emotional and mental well-being of people under 21. The law took effect upon approval and gives government entities no more than 90 days to implement its requirements.

Prison and license penalties for violations

A person who violates the law faces a fixed 15-year prison term; health professionals also lose their professional licenses. A business or other legal entity faces a $50,000 fine for each violation. It also loses all operating licenses and permits and is permanently barred from operating in Puerto Rico. Puerto Rico’s Department of Justice can investigate and sanction violations. It can also coordinate with federal entities to apply related rules.
