Para añadir un nuevo Artículo 6 a la Ley Núm. 94 de 22 de junio de 1977, según enmendada, conocida como la "Ley de Establecimientos para Personas de Edad Avanzada", a los fines de establecer y aclarar el proceso que deberá llevar a cabo el Departamento de la Familia para inspeccionar y certificar que toda institución para adultos mayores que opere en Puerto Rico cumpla cabalmente con los requisitos estatutarios y reglamentarios de esta Ley; establecer requisitos de inspección periódica, disponibilidad de energía alterna certificada, sistemas de agua potable, almacenamiento de suministros y otras condiciones de preparación en los establecimientos autorizados bajo dicha ley antes del comienzo de la temporada de huracanes; y para otros fines relacionados.

Stronger emergency readiness for elder-care homes

Licensed elder-care homes must have on-site backup power that runs normal operations. If they use a generator, they must keep fuel for 20 days or have a certified supplier contract. Each home must keep a potable water cistern for at least 5 days. Homes must stock medicines, food, and supplies for at least 20 days, as allowed by law. Medical equipment must be maintained and certified in working order. Generators and other systems must meet electrical safety and air-emissions certifications. Every home must keep a written emergency and disaster plan.

Quarterly and pre-storm inspections, with fines

The Department of the Family inspects each licensed home at least every 3 months. One inspection happens in the 90 days before hurricane season. Homes must show their generator and cistern were serviced within 30 days before the season, or file proof before it starts. The Department can do extra spot checks anytime. If a home misses the pre-season submission, it pays $1,000 for each week or part until fixed.

Six-month deadline and fast rule updates

Existing licensed homes that lack required systems have 6 months to comply. The Department may grant one extra 6‑month extension for just cause. After that, permits are suspended until an inspection certifies compliance. The law takes effect immediately. The Department must update and align its rules within 90 days, and it may add certification rules, including those tied to Law 88‑2018.

Residents can demand quick safety inspections

A resident, an adult family member, or any adult can ask for an inspection if over 3 months have passed or they know of an incident. Use the Department’s form. The Department must investigate and finish within 15 calendar days. If it does not, the petitioner can go to the adjudicative board to compel action. Homes must tell residents and families about this right on move-in and give the form and a copy of the law.
