Deadlines to set rules and go live

The Comptroller, Ethics Office, and Justice Department must adopt or update rules within 60 days. The Comptroller can begin or continue building the digital systems now. Most other parts of the law start 60 days after approval. The Legislative and Judicial branches have 90 days to update their internal reporting and sanctions rules. The law also repeals Article 74-A of the 1902 Political Code.

Report every loss of public money

All government entities in Puerto Rico must report every loss or irregularity of public funds or property. The agency head keeps an internal register, names liaison officers, and sets an investigation unit. Liaison officers enter cases in the Comptroller’s system and send the annual sworn certification due by August 31 each year. They keep the file until the Comptroller audits that period or the legal retention time ends. Files include Form SC-1062 (or successor), police or fire reports, investigation records, statements, and any referrals. The Comptroller runs the electronic registry and builds the digital tools, with help from PRITS when needed.

Fast investigations and required referrals

When a loss is found, the agency head orders an investigation within 10 business days. The investigation must finish within 20 business days. After the final decision, the liaison must notify the Comptroller and record the case within 10 business days. Reports include key dates, type of loss, complaint numbers, findings, and recommendations. If a public employee got an illicit personal benefit, refer the case to the Ethics Office within 15 business days. If a crime is likely or the loss is over $5,000, notify the Department of Justice right away. For losses of $5,000 or less, the agency imposes administrative sanctions and must tell Justice and Treasury if sanctions are ignored. The Comptroller may refer officials who fail to report to the Ethics Office for fines under Law 1-2012.
