Towns gain tire-hauling powers and payments

Puerto Rico municipalities can collect, handle, and haul discarded tires, including across municipal borders at tire businesses’ request. They can use municipal resources, work with other municipalities, or hire authorized transporters. Municipal staff need no extra government permit or approval; contractors remain subject to applicable laws. Municipalities are exempt from separate bond and insurance requirements when covered by the Municipal Code’s public liability insurance. The law also treats tires as recyclable materials for sorting at the source when a market exists. Municipalities acting as transporters must adopt local ordinances, follow environmental agency storage limits, and deliver tires to the nearest collection center or an authorized processing, recycling, export, or end-use facility. They must obtain shipping records showing origin, route, destination, tire count, and equivalent weight, and weigh vehicles before and after each haul. Receiving facilities must weigh the tires and complete and certify the delivery records. Municipalities can receive payment from the Discarded Tire Management Fund at the regulatory rates. Without an applicable rate, payment follows prevailing Puerto Rico freight rates consistent with transportation regulator rates. Payment is allowed only once for the same tires through their final destination. Municipalities must send supporting records to Treasury or the environmental agency, as applicable, within 90 days after delivery. The Treasury Secretary must transfer payment into a special municipal account within 60 days after receiving the invoice. The law takes effect immediately upon approval, and the environmental agency must update applicable regulations within 120 days.
