Bill Overview

Analyzed Economic Effects

5 provisions identified: 2 benefits, 1 costs, 2 mixed.

Earlier promotion chances for municipal police

Puerto Rico municipal police members can seek certain promotions after two years of municipal service, down from four. This covers Captain, Inspector, Commander, and Subcommissioner or Associate Commissioner. Current or retired Puerto Rico Police officers and officers from other jurisdictions can qualify without the two-year wait. They must meet the rank requirements and cannot be under investigation or subject to administrative corrective action. The Commissioner selects officers, subject to the Mayor's confirmation; eligibility does not guarantee promotion or higher pay.

Clearer legal status for police commissioners

Puerto Rico municipal police commissioners are public-order officials under Rule 11 of the Rules of Criminal Procedure. The public-order definition also includes Puerto Rico and municipal police, Justice Department Special Investigations Bureau agents, and Judicial Branch marshals. The Mayor remains the police force's principal director and appoints the Commissioner with the municipal legislature's approval. The Commissioner directly supervises the force, reports to the Mayor, and can receive duties delegated by the Mayor. These changes provide no direct household payment or guaranteed service improvement.

Longer transfer wait for municipal police

After training, municipal police members must serve three years in the municipality that appointed them before requesting a transfer. The prior wait was two years. This applies to transfers to another municipality or to the Puerto Rico Police. The exception in Article 3.026(d) remains in place.

New top rank for municipal police

Puerto Rico adds Subcommissioner or Associate Commissioner as the highest uniform supervisory rank; Commander becomes the fifth supervisory level. Both ranks require at least a bachelor's degree from an accredited institution. The Commissioner selects the new top-rank officer, with the Mayor's confirmation. Municipalities must update their police rules within 90 days of approval, when the law takes effect. Filling or keeping the position is optional and depends on service needs and available funds. People already holding the rank keep their accrued rights.

Municipalities repay training costs after transfers

A municipality receiving a police officer within three years after Academy graduation must repay the original appointing municipality's training costs. Payment is due within six months after the transfer takes effect. The original municipality recovers the costs it incurred, while the receiving municipality pays them. The law sets no fixed dollar amount and does not charge the officer.
