Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Automatic protective orders for abuse victims

When a court finds cause for arrest under Rule 6 for a Puerto Rico Law 54 offense, it must issue a protective order. No separate proceeding, victim consent, or usual application form is required. The order lasts at least six months for a first offense and at least one year for a repeat offender. The court may extend it for up to one additional year. The court must explain the order’s reason and scope to the victim.

Broader protections against domestic abuse

Puerto Rico’s domestic violence law now includes economic abuse and online abuse, including electronic tracking. Economic abuse includes blocking access to money, accounts, identification, credit, or government aid, and interfering with work or education. It also covers forced eviction, false claims about rent or mortgages, and misuse or withholding of financial resources. The law defines strangling, suffocation, and breathing restrictions caused by body position, and covers threats involving a victim’s companion animal. Covered relationships include spouses, former spouses, current or former cohabitants, intimate partners, and people who share a child. Protection applies regardless of sex, marital status, sexual orientation, gender identity, or immigration status. These broader rules expand victim protections and the conduct covered in domestic violence cases.

Abuse witnessed by families prompts reviews

After issuing a protective order, the court may refer the accused person for a social-work evaluation. Evidence must show that a qualifying person witnessed or perceived the abuse. This includes a child of either party, or an adult age 60 or older or person with a disability related to the victim by blood within the fourth degree. The court may hold a follow-up hearing to check attendance. After a referral, Puerto Rico’s Department of the Family must prepare an evaluation report, which may recommend psychological help.
