3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Seizure plans for students at school

The law requires a written Seizure Action Plan for each student with a seizure disorder. Parents must give the school a signed plan or doctor’s order that lists the medicine, dose, how to give it, and care steps, including vagus nerve stimulation if used. The plan is kept in the student’s school health record. The school must share the plan with listed staff and volunteers, and parents must share it with any non‑school caregivers named. The state education department sets rules for how plans are made and what they must include.

Trained staff can give rescue medicine

Parents can authorize school staff to give FDA‑approved nasal seizure rescue medicine when a nurse is not immediately available. Staff must complete seizure first aid training and have current CPR certification. Training can be taught by a doctor, physician assistant, advanced practice nurse, or registered nurse; the school nurse teacher is not required to teach it. Schools must keep pre‑dosed rescue medicine locked in a secure, designated place that is easy to reach in an emergency. Staff may volunteer to assist, and employees cannot be punished for refusing training. School districts and employees are protected from civil lawsuits if they act in good faith and follow the student’s plan and the provider’s instructions.

When seizure care rules apply

These rules apply only to schools that enroll a student with a seizure disorder or a prescribed FDA‑approved seizure medicine. A full‑time registered nurse who gives seizure medicines and oversees vagus nerve stimulation satisfies the school’s staffing and training duties. Permission to give seizure medicine lasts for one school year and must be renewed each year.
