Advanced practice nurses get mental health immunity

The law gives advanced practice registered nurses the same legal immunity as doctors in state mental health proceedings. It applies to APRNs who are licensed in Rhode Island or have privileges to practice here and meet the law’s requirements. They do not have to answer in court unless there is actual fraud or gross, willful, or wanton negligence. They are not liable for damages when a patient uses rights under this law, like discharge, against their written orders or advice. This immunity does not change the state’s medical discipline law in § 5-37-14 and takes effect upon passage.
