Foreclosure pause and rights for servicemembers

If you are on active duty and your mortgage began before your service, you have added protections. With written notice from you or your representative, the lender cannot sell while you are on duty or for nine months after, unless a court orders it. Any sale during that time is invalid without a court order or everyone’s agreement. You or your representative can ask the superior court in your county for a fast hearing to pause the case or adjust the loan. These rules cover mortgages and related secured debts that began before service (or before Guard/Reserve call‑up). A lender who knowingly breaks this rule can face up to a $1,000 fine, up to one year in jail, or both.

More notice before foreclosure for homeowners

Lenders must mail you a sale notice by First Class Mail or overnight delivery. Mail it at least 30 days before the first ad if you are an individual consumer, or 20 days if not. The notice goes to the property and any tax‑assessor or written address you gave. Newspaper ads must run once a week for three weeks: the first at least 21 days before the sale, and the third 7–14 days before the original sale date. The sale must happen within 14 days after the third ad, not counting the day it ran. If the sale moves to a later week, weekly ads must continue until that new sale week; no extra ads are needed if the sale stays in the same week. The notice must include a clear statement of servicemembers’ rights in at least 12‑point type, and the lender must record an affidavit of compliance in the foreclosure deed.
