Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Homeowners share private access road costs

If your home uses a private easement or right-of-way for access, you must help keep it in good repair, including snow removal, unless a written agreement says otherwise. When no agreement exists, benefited owners share maintenance and repair costs based on each home’s current municipal assessment. The higher your assessment compared with others, the larger your share. If you or your invitees cause damage, you alone must repair that part. Any enforceable written agreement between owners controls.

Easement cost demands must include proof

If you get a written demand for your share of easement repairs, it must include proof of the damage and repair plans. It must also explain how your share was calculated using current municipal assessments. If an owner refuses to fix the damage or pay after a proper demand, other owners can sue in superior court to make them repair or contribute. Any enforceable written agreement between owners still controls.
