Bill Overview

Analyzed Economic Effects

4 provisions identified: 0 benefits, 0 costs, 4 mixed.

PLAs required on large public projects

The law requires project labor agreements (PLAs) on state public works jobs worth $25,000,000 or more. It applies to state contracting agencies other than the Rhode Island Department of Transportation. Local projects must use a PLA to get state aid if construction costs are $25,000,000 or more and the state pays 35% or more of those construction costs. State agencies may also choose to require PLAs on other projects.

Standard rules inside every PLA

When a project uses a PLA, it binds the lead contractor and all subcontractors through the bid and contract. Any contractor can compete, union or nonunion. Strikes and lockouts are barred, and disputes are handled fast with binding procedures. At least 15% of the total project workforce must be registered apprentices. A PLA may also set safety and legal‑compliance cooperation.

Cities and towns can choose PLAs

Local governments may choose to use PLAs on municipal construction projects. Any local PLA must follow the state PLA rules and include the mandatory terms. This is optional and can be used on any appropriate local project.

No PLA? Extra steps before bidding

If a covered large project will not use a PLA, the agency must issue a written decision at least 90 days before bids. The decision must explain why a PLA would not help secure enough qualified craft workers and be signed by a senior procurement official and reviewed by the agency head. This applies to state jobs of $25,000,000 or more, and to state‑assisted local jobs with at least $25,000,000 in construction costs and a 35% or higher state share. Bidders must file a certified staffing plan naming apprenticeship or training programs and recruiting sources. The plan becomes a material contract term and must be approved by the contracting agency (local agency for state‑assisted jobs).
