Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Stronger identity and deepfake fraud rules

The law expands crimes for identity fraud and impersonation. It covers making, selling, or holding fake IDs or document tools, even a single document, when used to defraud. It bans digital forgeries like deepfake audio or video used to trick people, and impersonating a person or a business to cause harm. It broadens what counts as identifying or financial information, including biometrics, account numbers, routing codes, and company logos. It does not apply to protected speech, law enforcement on duty, some tech makers, or someone under 21 who lies about age only to enter a licensed alcohol venue.

Tougher penalties for identity fraud

The law sets tiered punishments to deter identity crimes. A first conviction can bring up to 3 years in prison and up to a $5,000 fine. A second conviction carries 3 to 5 years and up to a $10,000 fine. A third or later conviction carries 5 to 10 years and at least a $15,000 fine.

Court can reduce sentences in elderly cases

In cases involving an elderly adult (age 60 or older), the court keeps its power to fix or reduce a sentence under Rule 35. This preserves a path for sentence corrections or reductions in these cases.
