Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

Harsher penalties for road rage crimes

Rhode Island now adds extra punishment when a crime is caused by road rage. For misdemeanors, you must pay at least $750 and can lose your license for up to one year. For felonies, the court adds 2 to 15 years in prison, at least a $1,000 fine, and license suspension up to 5 years or revocation up to 2 years. The extra prison time must run after the sentence for the original crime. These penalties are on top of all other penalties for the offense.

Fines fund safe driving education

All fines from road rage cases go into a special state fund. The money goes to the Department of Transportation. The department uses it to teach people about the harms of road rage and to promote safer driving.

New court steps for road rage cases

Prosecutors must tell the court by the first pretrial meeting, or in the charging papers, if they seek the road rage enhancement. The court must hold a sentencing hearing where both sides can present more evidence. A judge or jury must find beyond a reasonable doubt that road rage caused the crime before adding the extra penalty. The law does not create a new crime; it only adds punishment to the original charge.
