Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Guaranteed Medigap during Medicare open enrollment

During Medicare’s annual open enrollment, people with continuous coverage get guaranteed access to Medigap. You must have no coverage gap over 90 days since your first Medigap open-enrollment window. Insurers must accept you for any Medigap they sell for coverage that starts January 1. They cannot use medical underwriting or deny you for health reasons.

More Medigap access for under-65 disabled

Insurers that sell Medigap Plan A must offer it to people under 65 on Medicare because of disability or end-stage kidney disease. You must apply in the first six months after you get Medicare Part B, or in another window the commissioner sets. Insurers cannot use health questions or deny you. When you turn 65 and stay in Parts A and B, you get six months to buy any Medigap plan the issuer offers in Rhode Island. Under-65 enrollees in Medicare Advantage or Plan A also have guaranteed issue for any Plan A the insurer sells.

No duplicate Medigap and fewer exclusions

Medigap plans in Rhode Island cannot duplicate benefits that Medicare already pays. Plans also cannot deny or limit benefits for a preexisting condition after six months from when your coverage starts. A preexisting condition can only mean a condition you got advice for or treatment for in the six months before coverage begins.
