Stroke and lung disease presumption for SC firefighters
Beginning May 15, 2026, South Carolina presumes stroke and respiratory (lung) disease, along with heart disease, are work-related for qualifying firefighters. The presumption covers impairment that causes total or partial disability or death. You must be a bona fide member of a municipal, county, state, port authority, or fire control district fire department in South Carolina. If you joined after May 29, 1968, you had to be under age 37 when you joined. You must have passed a physical exam at entry (or by July 1, 2012) with a written report filed before any alleged injury showing no sign of the condition. The condition must start while fighting a fire, during a technical rescue, or during a strenuous firefighter training exercise, or within 24 hours after. Clerical, administrative, or sedentary work does not qualify. This presumption can be challenged with competent evidence.
