Family Court handles base juvenile cases

Beginning May 13, 2025, South Carolina shares jurisdiction with the United States for juvenile offenses on Department of Defense bases. This applies only when the U.S. Attorney or a federal court waives exclusive federal jurisdiction and the act is also a state crime or infraction. When that happens, South Carolina Family Court is the first court to hear the case, unless a judge moves it to circuit court under existing waiver rules. After jurisdiction is shared, state and local agencies can make written agreements with federal agencies to decide who investigates, prosecutes, and provides services.
