Starting May 12, 2025, the state runs a Waste Tire Grant Trust Fund to help counties and businesses recycle tires. Grants can fund processing plants, tire removal, research, buying recycled products, and markets like rubber-modified asphalt. A 10-member review committee vets proposals, and the State Solid Waste Advisory Council makes awards. Business grantees must meet job-creation rules. DES also works with the Department of Commerce on a statewide market plan and annual reviews.
You cannot install an unsafe used tire on a passenger car or light truck. Unsafe means tread worn to 2/32 inch or less, exposed plies, improper repairs, defaced DOT number, inner-liner or bead damage, internal separation, or a federal recall tire. The rule starts May 12, 2025. It does not cover retread sellers, tires on vehicles sold with wheels already on, or tires for farm or off-road use. The law does not create a new private lawsuit for negligence per se.
Starting May 12, 2025, you pay a $2 fee for each new or used DOT-numbered tire you buy. The fee does not apply to farm or agricultural tires. The Department of Revenue collects the fee monthly from sellers. $1.50 per tire (after credits) goes to counties for tire collection and recycling. The rest goes to the Waste Tire Grant Trust Fund run by DES.
Starting May 12, 2025, tire haulers moving 15 or more waste tires must use a state manifest for each load and submit it within 60 days. A copy must stay in the vehicle, and generators and receiving sites must keep records for three years. Haulers must place a DES decal on the back of the vehicle; late renewal penalties are $10, $25, $50, or $75 based on how late. The state keeps a list of permitted waste tire facilities, and retailers can contract registered haulers to deliver there. DES and the Department of Revenue share data and can require electronic reporting and audits.
Starting May 12, 2025, counties can set tipping fees on waste tires in certain cases. If tires are from out of state, lack a DOT number, or no fee was paid elsewhere, counties can charge up to $400 per ton. If you show proper documents, counties can charge up to $150 per ton. Counties may add charges for heavy or oversized tires and may ask for proof of purchase. They may not add extra fees on waste tires made in the county except as allowed above.
