Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Fewer fees count in high-cost loan test

Beginning May 18, 2026, some discount points and a conventional prepayment penalty do not count as fees. If the base rate is at most 1% above the conventional mortgage rate, up to 2 discount points are excluded. If the base rate is at most 2% above it, up to 1 discount point is excluded. These exclusions apply when adding up points and fees to see if a loan is a high-cost mortgage.

Conventional mortgage rate now uses federal index

Beginning May 18, 2026, the law defines the conventional mortgage rate using a federal index. It uses the average prime offer rate published by the Consumer Financial Protection Bureau. Use the rate posted on the last day your lender set your interest rate before closing. If that index is not available, the state administrator can adopt a substitute index.
