Spearfish property transfer requires continued public use
The law allows South Dakota’s Department of Game, Fish and Parks to transfer a disused hydroelectric plant to the Spearfish Canyon Foundation. The transfer covers about 3.75 acres in Lawrence County and can include related personal property and improvements. The Foundation must use the property as a historic preservation museum or for another public purpose. Ownership automatically returns to the state after two consecutive years without public use. The transfer must use a special warranty deed, with the state acting through the Department. It must follow state law’s signing requirements and remains subject to all applicable constitutional and statutory reservations.
