3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Free county voter records protect personal details

South Dakota county auditors must keep digital voter files open to free public inspection. Files include registration-card details, the last election voted in, and the last voter-information update date. They also include all absentee applications, mailing addresses, ballots requested, request and return dates, and absentee voting methods. Social Security numbers, driver license numbers, state nondriver ID numbers, and birth month and day stay private. Auditors must produce a complete file record by 11:59 p.m. the day before each county primary or general election. They must keep a rolling five-year archive. Purged or unregistered voters stay out of the master file, but their registration forms remain for 22 months.

Public gets weekly voter updates and archives

South Dakota's Secretary of State must maintain a computerized voter system; counties must send voter-file and absentee-log changes daily. Counties must send updated registration and election-history records by July 15 after each primary and December 15 after each general election. The Secretary must post statewide updates online each week, recorded by Monday at 11:59 p.m., including required county-file changes. A free, rolling five-year statewide archive must include the complete voter file and weekly updates. It must hide Social Security numbers, driver license numbers, state nondriver ID numbers, and birth month and day. The Secretary must set rules for maintaining files, county data transfers, finding duplicate registrations, and publishing information.

Voter lists have fee and use limits

South Dakota caps voter-list fees set by the Secretary of State's rules. Paper copies cost no more than $1,000 statewide, $100 per legislative district, or $50 per county or other local area. Updated partial paper lists cost no more than $100 statewide or $75 for a district, county, or other local area. Those partial lists cover changes within one year of buying the complete list; an electronic statewide file costs at most $225. Information from state or county voter files cannot be sold, used commercially, or posted with unrestricted internet access. Campaign activity and political polling do not count as commercial use; authorized paper-copy fees do not count as sales. Violations are Class 1 misdemeanors and can also bring civil penalties up to $2,000 per violation, paid into the general fund.
