New legal counsel rules for Haywood County
The law sets qualifications and duties for Haywood County's attorney and allows the county to hire other legal counsel. The attorney must hold a Tennessee law license; county residents get preference, but county residency is not required. Before taking office, the attorney must file an oath with the County Clerk. The oath promises to support the U.S. and Tennessee Constitutions and perform the job to the attorney's best ability. The attorney must advise and represent the County Commission, County Mayor, and other county officials on their official duties. This includes written legal opinions and help for elected or appointed officials and board and commission chairs. The attorney must advise on county bond sales and, when the Mayor or Commission requests, prepare and execute necessary legal papers. When officials make conflicting requests, the attorney must act in the county's best interest. The Commission can hire other or additional lawyers when it finds extra or specialized counsel necessary or appropriate. The law also replaces the old titles 'Quarterly County Court' and 'County Judge' with 'County Commission' and 'County Mayor.' The local approval process took effect when the act became law, but these changes require a two-thirds county legislative vote. The presiding officer must announce approval or nonapproval and certify it to the Secretary of State.
