County Attorney is main legal adviser

The County Attorney is legal counsel for Haywood County government. They advise and represent the County Commission, the County Mayor, and other county officials on official legal matters. The attorney must write legal opinions when needed and, when asked, prepare and execute legal papers for county bond sales. When officials give conflicting requests, the attorney acts in the county’s best interest.

Updates old county office titles

The law updates old titles in Haywood County’s laws. It replaces "Quarterly County Court" with "County Commission" and "County Judge" with "County Mayor." This keeps the law’s wording in line with current offices.

Who can serve as County Attorney

The law requires the Haywood County Attorney to be licensed to practice law in Tennessee. Preference goes to a Haywood County resident, but living in the county is not required. Before starting, the attorney must take the official oath. The signed oath is filed with the Haywood County Clerk.

County may hire outside lawyers

The County Commission can hire outside or extra lawyers when it needs added or specialized legal help. This gives the county access to needed expertise. It can also raise the county’s legal costs.
