Homeowners can get relief from septic rules
Effective upon becoming law, Tennessee's commissioner can grant septic-system variances that override stricter local rules in areas covered by § 68-221-410. Approval is not guaranteed. This authority excludes sewerage systems regulated under § 69-3-108 and septic systems serving multiple lots. It also excludes lots containing more than one single-family home with accessory buildings. Accessory buildings are secondary structures on the same lot that support the main home's residential use, including accessory homes, garages, barns, and sheds.
Homeowners may face septic variance filing
The commissioner can require a septic variance granted under § 68-221-410 to be recorded with the county register of deeds. Recording applies to the property covered by the variance and is not required in every case. Homeowners may face an added filing step or recording cost; the law sets no fee amount.
