State septic variances override local rules for homeowners

The state Commissioner can grant septic system variances that override stricter local rules in covered areas. The variance does not apply to sewer systems regulated under § 69-3-108, systems serving more than one lot, or lots with more than one single‑family home with accessory buildings. The law defines accessory buildings to include accessory apartments, garages, barns, sheds, and similar structures on the same lot. If you get a variance, the Commissioner can require it to be recorded with the county register of deeds, and you may pay routine recording fees. This law is now in effect.
