Tennessee strengthens oversight of care facilities

The law took effect upon becoming law. By January 1, 2027, Tennessee's Health Facilities Commission must ensure recent inspections for every nursing home licensed under the covered law. Each home's latest inspection must be no more than 15 months before December 31, 2026. The commission must submit its compliance plan to each legislative house's chief clerk by June 1, 2025. The commission must also include one assisted-care living industry representative. Qualified candidates may come from interested groups' lists, including the Tennessee Center for Assisted Living, LeadingAge Tennessee, and Argentum. The commission must negotiate with the federal Centers for Medicare and Medicaid Services for flexibility in its oversight procedures. This includes seeking a block grant waiver amendment under 42 U.S.C. § 1395aa; federal approval is not guaranteed. By January 31, 2026, it must report negotiation progress to both legislative speakers and the Senate and House health committee chairs.
