Fewer borrow-pit limits for Helene road recovery
The law exempts temporary borrow pits—sites supplying road-building material—from restrictions in Tennessee Code §54-1-128(b)(1)(A), (D), and (E). The pits must serve road construction under a contract with Tennessee’s state government. The project must be part of a state or local Hurricane Helene recovery effort. Its county must be included in a FEMA disaster declaration made September 26, 2024, through October 2, 2024. The exemption took effect when the act became law and expires June 30, 2039.
