Broader legal protections during overdose incidents

Beginning July 1, 2025, at 12:01 a.m., Tennessee expands the terms used in its existing overdose protections. Tennessee Code § 63-1-156 now uses “overdose” instead of “drug overdose” and “drug or alcohol violation” instead of “drug violation.” Covered violations are those under §§ 39-17-418, 39-17-425, 1-3-113, 39-15-404, 39-17-310, 57-3-412(a)(3)-(5) and (c), 57-4-203(b)(2), 57-5-301(d)-(e), and 57-5-303(a). People and conduct covered by this section receive its protections under these broader terms.

Workplace limits for alcohol license holders

Beginning July 1, 2025, at 12:01 a.m., Tennessee excludes some work-related violations from its overdose protections. Protections in § 63-1-156(b) do not cover violations listed in § 63-1-156(a)(3)(C)-(M) committed by title 57 alcohol license holders within their job duties. The same exclusion applies to employees who commit those violations while acting on the license holder's behalf. This exclusion does not cover the listed drug offenses under §§ 39-17-418 and 39-17-425.
