Background checks for released time course staff

Effective July 1, 2025, Tennessee requires background checks for released time courses starting with the 2025–2026 school year and continuing afterward. Course providers must identify instructors and other staff whose roles require being near participating students. Each person must complete a criminal history check before that school year begins or before starting a covered role. Checks must repeat at least every five years, and results must go to the provider for review. Before students are excused to attend, providers must certify compliance in writing to the local education agency. This certification must also confirm that no covered person has a conviction listed in Tennessee Code § 49-5-417(a).
