New record-clearing option for recovery court graduates

Beginning July 1, 2026, Tennessee law gives certified recovery court graduates a new route to seek criminal record clearing. You must successfully complete a certified program established under Title 16. The offense must qualify under § 40-32-107(a)(1). It must have occurred at least 10 years after your conviction under § 55-10-401. You cannot have more than one conviction under that section. You must finish all imprisonment or probation and meet every supervised or unsupervised release condition. You must also pay all fines, restitution, court costs, and other assessments required by your sentence. You cannot have a prior expunction for another offense under § 40-32-107(a), (b), (c), or (e). Courts cannot clear an offense involving a motor vehicle and alcohol or a controlled substance through this route. You must petition the court under § 40-32-108; approval is not guaranteed.
