New rules for local property tax deals

The law took effect upon becoming law. Municipalities can authorize corporations to negotiate agreements with their tenants for payments instead of property taxes. The municipality must find that this authority serves the corporation’s public purposes, and it can require its lawmakers’ approval. When proposed payments fall below normal taxes, the corporation must notify each affected taxing jurisdiction’s chief executive in writing. Each chief executive can state no objection or require approval by that jurisdiction’s lawmakers before the agreement is signed. The corporation can proceed if the chief executive does not respond within 10 days after receiving notice. For projects inside municipal limits, payments are split between the municipality and county using the tax split on the agreement’s signing date. Agreements entered into on or after July 1, 2026, are void and unenforceable if they violate the required authorization and review process. The law does not set household tax rates or payment amounts.
