New limits on AI mental health claims
Beginning July 1, 2026, Tennessee bans public claims that AI systems are, or can act as, qualified mental health professionals. The ban applies to anyone who develops or deploys these systems. AI includes models and systems that perform tasks linked to human intelligence, such as reasoning and learning. Violations are unfair or deceptive practices under the Tennessee Consumer Protection Act and trigger its remedies and penalties. Each violation carries a $5,000 civil penalty, overriding that act’s usual civil penalty limits.
