Stricter notary rules for registering affidavits
Effective upon enactment, affidavits presented for registration under Tennessee Code Annotated § 66-24-101 must be sworn before a notary public. Affidavits covered by subdivision (d)(3) are exempt. Covered affidavits must include this wording: “SWORN TO AND SUBSCRIBED before me this _ day of _____ [year]. Notary Public My Commission Expires: _______.”
Expanded property registration with stricter rules
Effective upon enactment, bonds for transferring real or personal property need all parties’ authenticated signatures to be registered. More real estate sale documents are eligible for registration, including agreements, contracts, memoranda, abstracts, affidavits, and similar documents. These sale documents need signatures from the proposed buyer and the owner, the owner’s attorney-in-fact, or a court-appointed representative. Signatures must be authenticated under Tennessee Code Annotated § 66-22-101. Both bonds and sale documents must state an expiration date with the day, month, and year.
