Parents retain unpaid support collection rights

Orders ending parental rights must state whether unpaid child support exists and the amount owed when entered. That debt remains available for collection, including through the Office of Recovery Services. Courts can reduce or eliminate it when evidence shows this more likely than not serves the child's best interests. Divorce decrees involving a child must also tell both parties that the office helps collect or enforce child support.

Parents get ongoing child care payment rules

Beginning July 1, 2026, courts and administrative agencies must include reasonable ongoing child care payments in child support orders. The parent who owes support pays this expense. Both parties must propose an amount when there is no existing order, a substantial change in circumstances, or a modification petition. Office of Recovery Services guidelines or cost tables set the starting amount and schedule. Courts can accept a different agreement or evidence supporting another amount or schedule. Orders must state payment timing, start dates, and end dates when appropriate, and credit payments already made. Courts can set payments at zero if evidence shows child care costs are more likely than not to be absent. Payments end when the child turns 13 unless the court orders otherwise.
