Beginning May 7, 2025, Utah sets affordability standards for homes in First Home Investment Zones. Rental homes qualify as affordable housing for households earning no more than 80% of county median income for their household size. For owner-occupied homes, the price standard is 80% of the county median home price. Proposals can instead use 80% of the ZIP code median price, based on county property-tax assessment data. They must show that using the ZIP code price helps meet the zone’s goals.
Beginning May 7, 2025, each First Home Investment Zone tax-increment collection period has its own base year. That base year is the calendar year before collection begins for the parcels included in that period. Municipalities, community reinvestment agencies and taxing entities apply the rule separately to each period and its parcels. This rule does not establish a direct household payment or tax change.
Beginning May 7, 2025, Utah’s First Home Investment Zones must contain 10–100 acres of developable land. Only land available for business or housing construction counts; parks, recreation facilities, open space, trails, parking, roads and other public facilities do not. Proposals must provide at least 30 homes per acre across at least 51% of that land. At least 50% of homes counted toward this requirement must be owner occupied. Counted homes inside the zone can mix with other uses; this permission does not cover homes outside the zone.
Beginning May 7, 2025, municipalities can count some outside homes toward First Home Investment Zone density and ownership requirements. These homes must be in the same municipality, in developments with at least six homes per acre. They cannot be in or eligible for a housing and transit reinvestment zone, or have building permits by zone approval. They must remain owner occupied for at least 25 years and cannot exceed half the homes counted for density. Density equals counted inside and outside homes divided by 51% of the zone’s developable acres.
