Summary

Minimum wage. Increases the minimum wage incrementally to $15.00 per hour by January 1, 2028. The bill codifies the adjusted state hourly minimum wage of $12.77 per hour that is effective January 1, 2026, and increases the minimum wage to $13.75 per hour effective January 1, 2027, and to $15.00 per hour effective January 1, 2028. Effective January 1, 2029, and annually thereafter, the bill requires the minimum wage to be adjusted to reflect increases in the consumer price index. This bill is identical to SB 1.

Virginia workers get higher minimum pay

The law raises Virginia’s minimum wage in steps. From January 1, 2026 to January 1, 2027, employers must pay at least $12.77 per hour or the federal minimum wage, whichever is higher. From January 1, 2027 to January 1, 2028, the floor is $13.75 per hour or the federal minimum, whichever is higher. From January 1, 2028 to January 1, 2029, the floor is $15.00 per hour or the federal minimum, whichever is higher. This applies to all employees in Virginia, and employers must meet the higher rate.

Minimum wage rises with inflation

Starting January 1, 2029, the state minimum wage increases every year with inflation. By October 1 each year, the Commissioner sets the next year’s wage using the U.S. CPI-U percentage change. The wage cannot go down. Employers must pay at least the higher of the adjusted state wage or the federal minimum wage.

Pay floor for workers in training

Beginning May 1, 2021, if you are in an employer-run training program that meets the Commissioner’s standards, your employer must pay at least the higher of the federal minimum wage or 75% of Virginia’s minimum wage. The training period cannot be longer than 90 days. This rule applies only while you are enrolled in the approved program.
