Repair spending rules for emissions waivers

Virginia's law organizes repair-spending rules for emissions waivers that can spare qualifying owners further repair costs. Waivers are available after a failed inspection and reinspection, or when onboard diagnostics are not ready at reinspection. General base thresholds are $175 for vehicles made before 1980 and $200 for vehicles made in 1980 or later. These amounts receive yearly inflation adjustments using 2012 as the base year. For inspections under § 46.2-1178(C), the base threshold is $450, adjusted yearly for inflation from 1990. Under § 46.2-1178(B), thresholds are $75 for vehicles made before 1981 and $200 for vehicles made in 1981 or later. The board can approve later base years allowed by federal rules and phase in the inflation-adjusted amounts. Owners need written proof of qualifying engine and emissions-system maintenance and repairs, including restoration or replacement of removed or disabled emissions controls. Counted repairs must be done by certified technicians; parts and labor count, but warranty-covered repairs do not. The Director sets and updates repair standards and procedures that determine which expenses qualify.

Drivers get clearer glass repair notices

Virginia's new Motor Vehicle Glass Act covers windshield, door, and window glass work, including related replacement parts and required calibration. Before work, shops must tell customers whether their vehicle has an advanced driver assistance system. For vehicles with these systems, shops must explain whether manufacturer guidance calls for calibration after windshield work. Shops must say whether they will calibrate to the manufacturer's specifications. If they cannot or will not, they must direct customers to a manufacturer-certified dealership or qualified specialist. After calibration, customers must get written notice stating whether it worked; unsuccessful calibration requires the same referral. Notices can include verifiable texts, emails, or app messages customers can access. The Attorney General enforces the act under Virginia's consumer protection law, and the law repeals the former glass provision, § 59.1-207.5:1.
