Summary

TPA-certified optometrists; sale and dispensation of Schedule VI controlled substances; requirements. Permits TPA-certified optometrists to sell and dispense Schedule VI controlled substances to their own patients provided that they obtain a license to do so from the Board of Pharmacy and comply with requirements related to dispensation, storage, packaging, labeling, recordkeeping, and reporting of the controlled substances sold and dispensed. The bill permits the Board of Optometry and the Board of Pharmacy to adopt regulations to implement the provisions of the bill and establish a limited-use license for TPA-certified optometrists pursuant to the bill. The bill exempts such initial regulations from the APA requirements. This bill is identical to SB 212.

Clinics need permits to dispense drugs

It is illegal to dispense controlled substances without a Board of Pharmacy license, unless state law or Board rules allow it. Any site that dispenses drugs must get a Board permit and follow its rules. If only one licensed practitioner sells drugs at the site, the permit fees are waived. The Board can give a limited‑use license to practitioners at nonprofit clinics to dispense Schedule VI drugs, but not the misoprostol‑plus‑methotrexate combination and not syringes or needles. The nonprofit facility must also get a limited‑use permit and follow the rules.

Optometrists can sell eye meds, with rules

Optometrists who are certified to prescribe can sell Schedule VI eye medicines to their own patients. The drugs must be in the original, unaltered package and for self-use at home, and only topical, eye, or oral forms are allowed. They cannot compound or repackage the drugs. The optometrist must have a Board of Pharmacy dispensing license, be on site during the sale, counsel the patient, and follow storage, labeling, record, and reporting rules. State inspectors can check the site for compliance. The Board of Pharmacy can issue a limited‑use license for these optometrists. This law does not expand what optometrists are allowed to prescribe, and the Boards set detailed rules.
