Summary

Department of Veterans Services; Virginia War Memorial division. Clarifies that the Commissioner of the Department of Veterans Services shall provide supervision of the Virginia War Memorial Foundation and any other nonprofit corporation established as an instrumentality to provide fundraising for the Memorial and assist in the details of administering the affairs of the Memorial as delineated by memoranda of understanding. This bill is identical to SB 112.

State safeguards unclaimed military medals

If the Commonwealth receives military medals, ribbons, or certificates with no known owner, the Memorial division takes custody. It keeps the items until the rightful owner claims them. The division makes reasonable efforts, based on its resources, to find and return the owner.

DVS control and Memorial use fees

The Virginia War Memorial is a division of the Department of Veterans Services. It and all its property remain Commonwealth property. The Commissioner manages operations and money and can set rules for use and visiting. These rules are not subject to the Administrative Process Act. The Department, with Board advice, sets programs, visitation policies, and fees to use Memorial spaces. The Commissioner also supervises the Memorial Foundation and other fundraising nonprofits under written agreements.

Honoring fallen and missing Virginians

Beginning July 1, 2019, the Memorial places the names and homes of record of Virginians killed in action from terrorism, a terrorist act, or any armed conflict after Dec. 6, 1941, on the Shrine of Memory. New qualifying names are added within one year of the confirmed date of death. Only people who meet these rules are placed on the Shrine. The Memorial also honors Virginians Missing in Action from the Vietnam War and those who served honorably but do not meet the Shrine rules.
