Summary

Electric utilities; pilot program for electric energy conservation, generation, and storage. Requires American Electric Power and Dominion Energy Virginia to each petition the State Corporation Commission by December 31, 2026, to conduct a pilot program for electric energy conservation, solar energy generation, and energy storage resources for low-income, elderly, and disabled individuals. The bill directs the Commission to convene a technical conference to evaluate the creation of an energy efficiency program meeting certain requirements by November 1, 2026. Under the bill, if the Commission determines that such a program is feasible for implementation by American Electric Power and Dominion Energy Virginia, the Commission shall require such utilities to petition for approval by May 1, 2027, to implement such programs. The bill has an expiration date of July 1, 2034. This bill is identical to SB 327.

Energy help for low-income, seniors, disabled

The law creates utility-run pilots for energy conservation, solar power, and energy storage. Phase I and Phase II utilities must file for approval by December 31, 2026. The pilots can run until July 1, 2034, unless the law changes earlier. First-year funding is $23 million for the Phase II utility and $5 million for the Phase I utility. Each later year, funding rises by the larger of the CPI-U change or the utility’s 15-year growth rate. Utilities must give incentives directly to customers. These incentives and the energy they produce count toward required energy-savings goals. Phase II utilities must try to prioritize low- and moderate-income, elderly, and disabled people in housing authority properties.

Study of Pay As You Save financing

By November 1, 2026, the State Corporation Commission holds a technical conference to study a Pay As You Save–style program. Any design must follow core elements from the model and EPA customer protections. If the Commission finds it feasible and in the public interest, both utilities must file for approval to implement by May 1, 2027.

Pilot costs recovered on electric bills

The law lets utilities recover pilot costs through customer rates. Costs include energy storage. Utilities can add these costs to bills under the state’s rate adjustment process. This can raise electric bills for customers in the service area.
