Summary

Collection and reporting of data related to adults charged with a criminal offense punishable by confinement in jail or a term of imprisonment; Virginia Longitudinal Data System. Allows the Virginia Criminal Sentencing Commission to contribute the statewide and locality-level data it collects on adults charged with criminal offenses punishable by incarceration to the Virginia Longitudinal Data System administered by the State Council of Higher Education for Virginia. The bill states that any data provided that contains any personal or case identifying information shall be kept confidential and shall not be subject to the Virginia Freedom of Information Act. This bill is identical to SB 480.

Annual public report and data tools

By December 1 each year, the Commission sends a report to the General Assembly, the Governor, and the Supreme Court Executive Secretary. It also posts a downloadable dataset that removes any personal or case identifying details. An online dashboard shows aggregated data by user-selected features. The agency does not have to provide data in formats it does not regularly use.

Statewide tracking of adult criminal charges

The Virginia Criminal Sentencing Commission collects statewide and local data each year on adults charged with offenses that can lead to jail or prison. State and local justice agencies and circuit court clerks must give requested data. If clerks use the statewide Circuit Court Case Management System, the Supreme Court’s Executive Secretary sends data when asked. Collected items include demographics, charge details, prior record, bail and bond, outcomes, and whether counsel was appointed. The Commission uses the data only for research and keeps it confidential and secure.

Privacy rules and research data links

Agencies and circuit court clerks do not have to provide data they do not regularly keep or that law or professional rules bar from disclosure. The Commission may send its data to the Virginia Longitudinal Data System to link with other datasets. It may include identifying details only to create de-identified research files. Identifying details stay confidential and are not released or subject to the Virginia Freedom of Information Act.
