Summary

Virginia Public Procurement Act; preference for Virginia goods; school nutrition programs; sunset extension. Provides that, in the case of procurement of goods by manufacturers, if the lowest responsive and responsible bidder is not a resident of Virginia and the bid is for agricultural products that are produced or processed in Virginia and intended for school nutrition programs, including fresh fruits, vegetables, and dairy products, and is within 20 percent of such bid, such bidder for agricultural products that are produced or processed in Virginia shall be granted the option to match the price of the lowest responsive and responsible bidder. The bill amends provisions of law providing preference for Virginia goods in procurement that are set to expire on July 1, 2027. The bill extends the sunset date of these provisions to July 1, 2028.

Stronger bid edge for Virginia businesses

Virginia resident bidders can match the lowest responsible bid at award time. For most goods, your bid must be within 10%. For Virginia-grown or processed food for school nutrition, it can be within 20%. If the lowest bidder is from a state that gives its residents a preference, Virginia matches it; if that state gives an absolute preference, that bid is not considered. You get the greater of any preferences, and you count as a Virginia resident if you are organized under Virginia law or your main office is in Virginia. These rules run through July 1, 2028.

Preference timeline, state list, and federal limits

The law keeps these procurement preference rules in place through July 1, 2028. If applying them would conflict with federal law or make a project lose federal funds, the preferences do not apply. The Department of General Services must keep an online list of states that give contractor preferences and the percent amounts, and public bodies can rely on it.

Tie-breakers favor Virginia-made and recycled goods

If bids tie, buyers pick goods made in Virginia first. If none, they pick U.S.-made goods. If a tie remains after other price preferences, buyers choose the goods with the most recycled content. If still tied, the winner is chosen by lot. These rules stay in effect through July 1, 2028.
