Department of Taxation; free tax filing program for individuals. Directs the Tax Commissioner to develop and offer a free individual state income tax filing program, effective beginning in taxable year 2028, that is similar to the federal Internal Revenue Service (IRS) Direct File Program as it existed during the 2025 tax filing season. The bill contains technical amendments that remove obsolete language regarding fillable forms. This bill is identical to SB 591.

Free Virginia tax filing starts 2028

Beginning with tax years that start on or after January 1, 2028, Virginia offers a free, state-run e-file system for individual taxpayers. The program charges no fees to use. Eligibility rules must be less restrictive than the IRS Direct File program as it existed in the 2025 filing season. The Tax Commissioner considers security and how the system works with the IRS Direct File 2025 open-source code, consults with other states as needed, and keeps it compatible with any federal free e-file system. The law also repeals the 2010 chapter that supported the older Virginia Free File arrangements to support this transition.

Online fillable Virginia tax forms

The Department of Taxation provides fillable PDF versions of all required Virginia tax forms on its website. Beginning January 1, 2012, forms must be available online, with all forms required by March 1, 2013. The Department posts user guidelines on how to use the forms. This does not replace or compete with the Virginia Free File program.
