Summary

Public school teachers; terms of employment; reemployment of teacher who has received continuing contract status; written notice required. Requires written notice of noncontinuation of a continuing teacher contract to be given by the teacher by June 15 of each year; otherwise, the contract continues in effect for the ensuing year in conformity with local salary stipulations, including increments. Current law requires such written notice of noncontinuation of a continuing teacher contract to be given by either the teacher or the school board by June 15 of each year. This bill is identical to SB 117.

Teacher contract deadlines and pay confirmations

If you are a probationary teacher, you must accept or reject a reemployment notice in writing within 15 days. The board must send any nonrenewal notice by June 15; if not, you get a contract for next year with local pay and step increases. If you have a continuing contract, you or the board must give notice by June 15 or your contract continues for the next year with pay and steps. After June 15 and once the school budget is approved, the board must send you a statement confirming your job, assignment, and salary. Contracts still depend on approved funds; the board cannot promise money beyond funded periods.

Teacher layoffs: notice and performance rules

The school board may cut teaching positions if enrollment falls or a subject is ended. Within two weeks after budget approval, but no later than July 1, the board must notify teachers who may be cut for budget reasons. Layoff decisions cannot be based on seniority alone; the board must also consider teacher performance evaluations. These rules apply to both probationary and continuing‑contract teachers.

Teacher resignation rules after June 15

After June 15, you can resign only with school board approval, or an authorized superintendent’s approval, and you must ask at least two weeks before your date. If the superintendent is authorized, you may withdraw your resignation within one week. After that, the superintendent informs the board, and the board can reverse the decision within two weeks. If your release is denied for insufficient or unjustifiable cause and you leave anyway, you may face discipline, including a reprimand, suspension, or loss of your teaching license.
