Summary

Commercial motor vehicle; definition. Expands the definition of a commercial motor vehicle to include vehicles inclusive of a towed vehicle with a gross vehicle weight or a gross vehicle weight rating of more than 10,000 pounds. Currently, the definition includes, in relevant part, a towed vehicle with a gross vehicle weight rating of more than 10,000 pounds. The new definition is consistent with Federal Motor Carrier Safety Administration regulations.

Training and permits for new CDL drivers

Entry-level drivers must finish training from a provider on FMCSA’s Training Provider Registry before testing. This applies to a first CDL, first Class A or B upgrade, passenger or school bus endorsements, and the hazardous materials knowledge test. A commercial learner’s permit (CLP) lets you drive only for training when you carry it with your same-state driver’s license and ride with a licensed commercial driver. If you already have a CDL, a CLP lets you train in vehicles your CDL does not cover, with a licensed commercial driver. Training takes time and usually costs money.

Seasonal farm CDL within 150 miles

The state issues a seasonal restricted CDL under a federal waiver. It is only for seasonal employees of a farm service business. You may drive only during the season shown on the license and only within 150 miles of the farm or business you serve. You can get this license without passing the usual CDL knowledge or skills tests.

More vehicles now count as commercial

The law sets when a vehicle is a commercial motor vehicle. It is commercial at 26,001+ pounds GVW, 26,001+ pounds combined weight with a towed unit over 10,000 pounds, if it seats 16+ people including the driver, or if it carries hazardous materials. These rules apply whether or not the vehicle is used for profit. Personal-use vehicles are excluded. Some farm vehicles within 150 miles, military vehicles, and emergency equipment on duty are also excluded. A tank vehicle is any CMV with any tank over 119 gallons and total tank capacity of 1,000+ gallons, even if the tank is only temporarily attached. Portable tanks under 1,000 gallons and some empty storage tanks on a flatbed are excluded.
