Summary

Mortgage lenders and brokers; criminal history records check. Replaces the option for an applicant submitting the required criminal history records check for licensure as a mortgage lender or mortgage broker, or an applicant to acquire control of a licensee, to submit fingerprints and other information to the Commissioner of Financial Institutions to forward such information to the Central Criminal Records Exchange with the option to submit such information to an FBI-approved channeler to forward such information to the FBI for the purposes of obtaining national criminal history record information. Under current law, there is also an option for such an applicant to submit such information to the Nationwide Mortgage Licensing System and Registry.

Fingerprint checks for mortgage license applicants

Applicants for a mortgage lender or broker license must have each member, senior officer, director, and principal complete state and national criminal background checks. They must be fingerprinted and pay the fingerprint and records‑check fees. Fingerprints and information are sent through an FBI‑approved channeler or through the Nationwide Mortgage Licensing System, if it can process them. If any required person does not submit the fingerprints, information, or fees, the Commission must deny the license.

Buying 25% of a mortgage company

To buy 25% or more of a licensed mortgage lender or broker, you must apply to the Commission first and pay the application fee. You must give financial and background details and list your directors, senior officers, principals, and members. Those people must complete state and national background checks, be fingerprinted, and pay those fees. The Commission decides within 60 days after a complete, paid filing, unless the Commissioner extends it by written order. If your deal is exempt, you must send written notice within 30 days after closing.
