Primaries; abstract of votes, law-enforcement officer to obtain returns not forwarded.

Sponsored By: Bonita G. Anthony (Democratic)

Became Law

Summary

Elections; conduct of primaries; abstract of votes; law-enforcement officer to obtain returns not forwarded. Removes the requirement that if the abstract of votes is not received by the State Board of Elections from any county or city within six days after any state primary election, the State Board shall dispatch a law-enforcement officer to obtain it. The bill removes a conflict with an existing provision that requires the State Board to dispatch law-enforcement when the abstract of votes is not received within 10 days after any election.

Faster reporting of primary results

When a local electoral board decides primary winners, its secretary must at once prepare the official vote abstracts and certificates. The secretary must send certified copies to the State Board of Elections right away. The secretary must also deliver certified copies, in person or by certified mail, to the right party chair: for U.S. House to the congressional district chair, for General Assembly to the Senate or House district chair, and for local offices to the county or city chair. In this law, “chairman” means the party chair of the party that held the primary. If the State Board has not received a county or city abstract within 6 days after a state primary, it sends a law-enforcement officer to get it.
