Governor can call National Guard for emergencies

The Governor or his designee can call the Virginia militia, including the National Guard, to state active duty. Triggers include invasion or insurrection, mass obstruction of laws, and help for named law‑enforcement functions the Governor specifies. The Guard can respond to floods, hurricanes, fires, other disasters, and smaller emergencies that disrupt vital public services. The Guard can support drug interdiction and demand‑reduction work, including under the National Guard counterdrug compact. The Adjutant General reports these drug‑support activities to the Governor at least every three months. The Guard can give cyber preparedness, response, and mitigation help to state or local agencies and to private critical‑infrastructure operators. The Governor, with the Adjutant General, can order related training and can let the Guard sign support agreements with state or federal law‑enforcement agencies that match the call.

National Guard can receive federal forfeitures

The law treats the Virginia National Guard as a state law‑enforcement agency only so it can receive property and money under certain federal forfeiture laws. This is a narrow, administrative change. It does not make the Guard a general police agency or change other duties.
